Air Source Covers Ltd
Overview
This website is operated by Air Source Covers Ltd. Throughout the site, “we”, “us” and “our” refer to Air Source Covers Ltd. We offer this website, including all information, tools and services available on it, to you, the user, on condition that you accept all the terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (the “Terms”), including any additional terms, conditions and policies referenced here or available by hyperlink. These Terms apply to all users of the site, including without limitation browsers, vendors, customers, merchants and contributors of content.
Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all of them, you may not access the website or use the Service. Where these Terms are considered an offer, acceptance is expressly limited to these Terms.
Any new features or tools added to the store are also subject to these Terms. You can review the current version of the Terms at any time on this page. We reserve the right to update or change these Terms by posting changes to our website, and it is your responsibility to check this page periodically. Continued use of the site after changes are posted constitutes acceptance of those changes.
Our store is hosted on Squarespace, which provides the online e-commerce platform used to sell our products and services to you.
Section 1 – Online Store Terms
By agreeing to these Terms, you confirm that you are at least 18 years old (the age of majority in the United Kingdom), or that you have the consent of a parent or guardian to use this site on behalf of a minor.
You may not use our products for any illegal or unauthorised purpose, and you must not, in using the Service, break any law applicable to you, including copyright law.
You must not transmit any worms, viruses or code of a destructive nature.
A breach of any of these Terms will result in immediate termination of your access to the Service.
Section 2 – General Conditions
We reserve the right to refuse service to anyone, for any reason, at any time.
You understand that your content (excluding payment card information) may be transferred unencrypted and may involve (a) transmission over various networks, and (b) changes to conform to the technical requirements of connecting networks or devices. Payment card information is always encrypted in transit.
You agree not to reproduce, duplicate, copy, sell, resell or otherwise exploit any part of the Service, or access to it, without our express written permission.
Headings in these Terms are for convenience only and do not affect their interpretation.
Section 3 – Accuracy, Completeness and Timeliness of Information
We are not responsible if information on this site is inaccurate, incomplete or out of date. Material on the site is provided for general information only and should not be relied upon as the sole basis for any decision without consulting more accurate, complete or current sources. Any reliance on material on this site is at your own risk.
This site may contain historical information, which is provided for reference only and is not necessarily current. We may modify the content of this site at any time but have no obligation to update it, and it is your responsibility to monitor any changes.
Section 4 – Changes to the Service and Prices
Prices for our products may change without notice.
We may modify or discontinue the Service, or any part of it, without notice at any time.
We are not liable to you or any third party for any modification, price change, suspension or discontinuation of the Service.
Section 5 – Payment
Payment is taken in full at the time of order, before your order is processed. We accept payment by the methods offered at checkout. All prices are shown in pounds sterling (GBP) and are inclusive of VAT at the applicable rate, unless stated otherwise.
Section 6 – Products or Services
Certain products or services may be available exclusively online. These may be available in limited quantities and are subject to return or exchange only in accordance with our Returns Policy.
We make every reasonable effort to display product colours and images accurately, but we cannot guarantee that your monitor will display colours accurately.
We reserve the right, though we are not obliged, to limit sales of our products or services to any person, geographic area or jurisdiction, on a case-by-case basis, and to limit the quantities of anything we offer. Product descriptions and pricing are subject to change at any time at our discretion, and we may discontinue any product at any time. Any offer for a product or service made on this site is void where prohibited.
We do not warrant that products, services, information or other material purchased or obtained through the site will meet your expectations, or that any errors in the Service will be corrected.
6.1 Disclaimer of Liability
Damage or effect: Air Source Covers Ltd is not liable for any damage or adverse effect caused by the use of our covers. Use of our covers is at the customer's own risk, and we disclaim responsibility for any direct or indirect damage that may arise.
Misuse: we hold no liability for any damage, injury or loss of life resulting from misuse of our covers. Misuse includes, without limitation, installation that does not follow the instructions, guidelines or industry standards provided with the product. Customers are responsible for installing and using covers in accordance with any guidelines, instructions or industry standards provided.
Incorrect sizes: we are not liable for covers ordered to incorrect sizes. Customers are solely responsible for providing accurate measurements and specifications, and any discrepancy in sizing is the customer's responsibility.
Manufacturing tolerance: as our covers are manufactured individually, finished dimensions may vary from the specification ordered by up to ±10mm. This tolerance is a normal part of the manufacturing process and does not constitute a defect.
Section 7 – Made-to-Order Products
7.1 Customisation and Bespoke Production
Certain products are categorised as “Made to Order”. These are manufactured to the specific measurements and preferences of the individual customer, and their production requires additional time and resources.
7.2 Order Placement
By placing an order for a Made-to-Order product, you acknowledge that production may begin promptly after your order is submitted. Please review your order carefully, including all customisation details, as changes may not be possible once production has started. Made-to-Order items must be paid for in full before the order is processed.
7.3 Returns and Exchanges
Returns and exchanges of Made-to-Order products are subject to different terms, owing to their bespoke nature, and will only be considered where the product is defective or damaged. If you receive a Made-to-Order product that is defective or damaged, please contact us immediately and we will arrange a replacement or refund.
7.4 Refunds and Exchanges
Whether a refund, exchange or replacement is appropriate for an eligible return of a Made-to-Order product will be assessed on a case-by-case basis, given the bespoke nature of each item.
7.5 Communication and Customer Support
Our customer service team is available to help with any queries about Made-to-Order products. Please contact us at info@airsourcecovers.co.uk.
7.6 Amendments
We may amend the terms governing Made-to-Order products at our discretion. Any changes will be published on our website and will apply to orders placed after the effective date of the update.
Section 8 – Delivery of Products
8.1 Shipping
We offer various shipping methods, with costs shown at the time of order. We currently ship to England, Scotland and Wales; if you need delivery elsewhere, please contact our customer service team.
8.2 Delivery Timeframes
Estimated delivery times are shown at checkout and are calculated from the date the order is processed; they may vary by destination, shipping method and unforeseen circumstances. We are not liable for delays outside our control, but please contact us if you experience a significant delay.
8.3 Order Processing
Orders are typically processed within 20 working days of being placed. Made-to-Order or customised items may take longer, as specified during the ordering process.
8.4 Delivery Charges
Shipping costs are calculated based on the method chosen, the destination, and the weight or dimensions of your order, and will be shown before you complete your purchase.
8.5 Delivery Address
Please ensure the shipping information you provide at checkout is accurate and complete. We are not responsible for undelivered packages resulting from incorrect or incomplete address details.
8.6 Tracking and Notifications
Once your order has shipped, you will receive tracking information. We will make reasonable efforts to notify you of any change in delivery status, but please also refer to the carrier's own updates.
8.7 International Shipments
For any international shipments, customs duties, taxes or import charges may be applied by the destination country and are the customer's responsibility. We are not responsible for customs-related fees or issues.
8.8 Receipt and Inspection
Please inspect your order on receipt for any visible damage. If you notice damage to the product or packaging, report it to the delivery courier and notify us straight away.
8.9 Non-Delivery
If you do not receive your order within the estimated timeframe, or believe it has been lost in transit, please contact our customer service team and we will investigate with the carrier.
8.10 Changes to this Shipping Policy
We may update our shipping policy from time to time. Changes will be posted on our website and will apply to orders placed after the update takes effect.
Section 9 – Cancellation Rights
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers ordering online normally have a 14-day right to cancel from the day after delivery.
However, this cancellation right does not apply to goods made to your specification or clearly personalised, such as our Made-to-Order/bespoke covers. As set out in Section 7, once production of a Made-to-Order item has begun, the order cannot be cancelled except where the product is defective or damaged.
Where we sell any non-bespoke, off-the-shelf item, the standard 14-day cancellation right applies to that item in the usual way.
Section 10 – Accuracy of Billing and Account Information
We reserve the right to refuse any order, and may limit or cancel quantities purchased per person, household or order, including orders placed using the same account, payment card, or billing or shipping address. If we change or cancel an order, we may try to notify you using the contact details provided when the order was placed. We may also limit or refuse orders that, in our judgement, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate account and purchase information, and to keep it up to date, including your email address and payment details, so that we can complete your transactions and contact you if needed. For further detail, please see our Returns Policy.
Section 11 – Optional Tools
We may give you access to third-party tools that we do not monitor or control. You acknowledge that such tools are provided “as is” and “as available”, without any warranty or endorsement from us, and that we have no liability arising from your use of them. Use of any optional third-party tools is entirely at your own risk, and you should review the relevant third party's own terms before using them.
We may in future offer new services or features through the website, which will also be subject to these Terms.
Section 12 – Third-Party Links
Some content, products and services available through our Service may include material from third parties, and third-party links on this site may take you to websites not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we do not warrant or accept liability for any third-party material, websites, products or services.
We are not liable for any harm or damage relating to the purchase or use of goods or services obtained through a third-party website. Please review any third party's own policies carefully before transacting with them; complaints about third-party products should be directed to that third party.
Section 13 – User Comments, Feedback and Other Submissions
If you send us comments, suggestions, ideas or other submissions, whether at our request or otherwise, you agree that we may use, edit, copy, publish and distribute them in any medium, without restriction. We are under no obligation to keep any submission confidential, to pay for it, or to respond to it.
We may, but are not obliged to, monitor, edit or remove content that we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that breaches these Terms or a third party's rights.
You agree that your comments will not infringe any third party's rights, including copyright, trademark or privacy rights, and will not be unlawful, abusive or obscene, or contain any virus or malware. You must not use a false email address or impersonate anyone else. You are solely responsible for your comments and their accuracy, and we accept no liability for comments posted by you or any third party.
Section 14 – Personal Information
Your submission of personal information through the store is governed by the Data Protection Act 2018 and the UK General Data Protection Regulation (UK GDPR).
Section 15 – Errors, Inaccuracies and Omissions
Our site or Service may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct these and to change or update information, or cancel orders, if anything on the site is inaccurate, at any time and without prior notice, including after an order has been submitted.
We are under no obligation to update, amend or clarify information on the site, including pricing, except where required by law, and no update or refresh date should be taken to mean that all information on the site has been revised.
Section 16 – Prohibited Uses
In addition to other prohibitions in these Terms, you may not use the site or its content:
(a) for any unlawful purpose; (b) to solicit others to perform or take part in unlawful acts; (c) to breach any UK or international regulations, laws or local ordinances; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information;
(g) to upload or transmit viruses or other malicious code that could affect the functioning of the Service, this site, other websites or the internet; (h) to collect or track others' personal information; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or improper purpose; or (k) to interfere with or circumvent the security features of the Service or any related website. We may terminate your use of the Service for breach of any of these prohibitions.
Section 17 – Your Statutory Rights; Disclaimer of Warranties; Limitation of Liability
We do not offer any additional product warranty on our covers. This does not affect your statutory rights as a consumer, which are unaffected by anything in these Terms.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, including your right to goods that are of satisfactory quality, fit for purpose and as described. Where these Terms conflict with those statutory rights, your statutory rights take precedence.
We do not guarantee that your use of the Service will be uninterrupted, timely, secure or error-free, or that results obtained from using the Service will be accurate or reliable.
We may remove or cancel the Service for any period, or permanently, without notice.
Your use of, or inability to use, the Service is entirely at your own risk. The Service and all products and services delivered through it are provided “as is” and “as available”, without warranties or conditions of any kind, whether express or implied, including implied warranties of satisfactory quality, fitness for a particular purpose, durability, title and non-infringement, except as expressly stated by us or required by law.
To the fullest extent permitted by law, Air Source Covers Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers and licensors will not be liable for any injury, loss, claim, or direct, indirect, incidental, punitive, special or consequential damages of any kind — including lost profits, lost revenue, lost savings, loss of data or replacement costs — arising from your use of the Service or any product obtained through it, whether in contract, tort (including negligence), strict liability or otherwise, even where we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights under the Consumer Rights Act 2015.
Section 18 – Indemnification
You agree to indemnify and hold harmless Air Source Covers Ltd, and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable legal fees, made by a third party arising from your breach of these Terms or your violation of any law or third-party right.
Section 19 – Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will nonetheless be enforced to the fullest extent permitted by law, and the unenforceable part will be severed, without affecting the validity of the remaining provisions.
Section 20 – Termination
Obligations and liabilities that arose before termination will survive termination of this agreement.
These Terms remain effective until terminated by you or us. You may terminate them at any time by telling us you no longer wish to use our Service, or by ceasing to use the site.
If we believe, in our judgement, that you have failed to comply with any term of these Terms, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to the date of termination, and we may deny you access to the Service.
Section 21 – Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms does not amount to a waiver of that right or provision.
These Terms, together with any policies or operating rules posted on this site, constitute the entire agreement between you and us in respect of the Service, and supersede any prior agreements, communications or proposals, whether oral or written, including earlier versions of these Terms.
Any ambiguity in these Terms will not be construed against whichever party drafted them.
Section 22 – Governing Law
These Terms, and any separate agreement under which we provide you with services, are governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction over any dispute.
Section 23 – Dispute Resolution
If you have a complaint, please contact us in the first instance at info@airsourcecovers.co.uk so that we can try to resolve it directly.
If we are unable to resolve a complaint between us, you may refer the matter to RetailADR, a certified Alternative Dispute Resolution (ADR) provider approved by the Chartered Trading Standards Institute, at www.retailadr.org.uk. We are not currently a member of this or any other ADR scheme and are not obliged to use one, so we cannot guarantee that we will participate if you refer a dispute to them; however, you remain free to submit a claim.
This does not affect your right to bring a claim through the small claims court or other court proceedings at any time.
Section 24 – Changes to These Terms
You can review the current version of these Terms at any time on this page. We may update or change these Terms at our discretion by posting changes to our website, and it is your responsibility to check periodically. Continued use of the site or Service after changes are posted constitutes acceptance of those changes.
Section 25 – Contact Information
Questions about these Terms should be sent to us at info@airsourcecovers.co.uk.
